FDA says nicotine water is an illegal drug, can’t be sold.

The FDA ruled that water laced with nicotine that was billed as a “refreshing break to the smoking habit,” was an illegal drug and could not be sold.

The California firm, QT5 Inc., planned to launch NicoWater later this month as a dietary supplement and had thought that the FDA wasn’t allowed to regulate supplements nearly as strictly as it does medications.

Since nicotine is legally sold over-the-counter in FDA-approved smoking cessation aids, federal law prohibits it also be sold as a dietary supplement.

The FDA also cracked down on nicotine-laced lollipops and lip balm last April, calling them unapproved drugs that had enough nicotine to endanger children lured by the candy resemblance.
