Victory For Device Industry

Medical device manufacturers came out on top with a Supreme Court decision (8-1) on Wednesday that makes it harder for consumers to sue the makers of federally approved devices.

The court held that the Medical Device Amendments to the FD&C Act bar state liability suits against manufacturers of a "medical device marketed in a form that received premarket approval from the FDA."

Justice Ruth Bader Ginsburg was the sole dissenting voice. Wednesday's ruling is "at odds with the (law's) central purpose: to protect consumer safety," Ginsburg said.
